FillTheGame Terms of Use

These terms are an agreement between you and PRODUCTIEE TECHNOLOGIES (ABN 11 373 881 322) ("FillTheGame", "we", "us", "our"). They cover your use of the FillTheGame website and web app (the "Service").
By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the Service.
1. What FillTheGame is
FillTheGame helps people find others to play pickleball with. You tell us when you're free, roughly where and your skill level. We try to match you with three other players nearby at a similar level, and we open a group chat so you can organise the game.
What FillTheGame is not:
- We don't book, own, run or supervise courts or venues. Your group arranges the court, and any court fees are between your group and the venue.
- We don't employ, vet, screen or background-check players. Other players are members of the public.
- We don't guarantee that you'll be matched, that a game will go ahead, or that other players will turn up or behave well.
2. Who can use FillTheGame
To use the Service, you must:
- be 18 or over
- be able to form a legally binding contract
- not have had an account suspended or removed by us before, unless we've agreed otherwise
- give us accurate information, including your real first name, and keep it up to date
You can have only one account. You're responsible for keeping your password secure and for everything that happens under your account. Tell us straight away at [email protected] if you think someone else has used it.
3. How matching works
- You start a search by choosing when you're free, your location and travel radius, your skill level and your preferences. You can only have one active search at a time.
- We look for a group. Our matching system automatically looks at who else is searching, and considers time overlap, distance, skill, reliability and how long people have been waiting. Matching is automated and we don't promise any particular outcome.
- You're invited. When a group forms, we email you and you have 15 minutes to accept or decline. If you don't reply in time, you're treated as having declined and you go back to searching if time allows.
- The game is confirmed once everyone accepts. A chat opens for your group.
- If someone drops out, we'll try to find a replacement. If nobody can be found before the game, the group may play short-handed or the game may be cancelled.
- Searches expire if no game is found before your available time has passed.
Game times, locations and "players nearby" or "likelihood" figures shown in the app are estimates to help you. They aren't promises.
4. Credits and fees
FillTheGame is currently free. Your account has unlimited credits, so there's nothing to buy or top up.
We may introduce paid credits or other fees in the future. If we do, we'll tell you in advance, and you'll never be charged unless you choose to buy something. Credits have no cash value and can't be transferred or exchanged for money, except where the law requires otherwise.
5. Showing up: cancellations and no-shows
A game only works if everyone who confirms turns up. When you accept a game, you're committing to three other people.
- Cancel as early as you can. You can cancel a confirmed game from the app until it starts.
- Cancelling more than 24 hours before the start is free.
- Cancelling within 24 hours, or not turning up, affects your reliability score (see section 6).
- If you can't make it after the game has started, tell your group in the chat.
6. Reliability score
Every player has a reliability score from 0 to 100. It's shown to the other players in your games and it's one of the things our matching system considers.

We may also adjust scores manually to correct a mistake or to reflect the outcome of a review. You can see your score and every change to it on your Profile. If you think a change is wrong, tell us through Help & feedback and we'll look into it.
7. Reports and complaints
You can report a player in one of your games:
- No-show: from 15 minutes after the game's start until 7 days after it ends. One report on its own changes nothing. If a second player from the same game reports the same person, the no-show is applied automatically; otherwise our team reviews it.
- Complaint: for harassment, inappropriate behaviour, spam or scams, a safety concern, or anything else. Our team reviews every complaint.
We keep the identity of the person who reported or complained private. Only make reports that are honest and in good faith. Making false or malicious reports is a breach of these terms. We limit how many reports a player can make in a period of time.
If you're in danger, call 000 first. FillTheGame isn't an emergency service, and reports aren't monitored around the clock.
8. Community rules
When you use FillTheGame, including in chats and at games, you must not:
- harass, threaten, intimidate, bully, stalk or discriminate against anyone
- behave in a sexually inappropriate or violent way
- post anything unlawful, defamatory, hateful, obscene or misleading
- share another player's personal information without their consent
- use the Service or a player's details to advertise, sell, solicit or send spam, or to run a scam
- use the Service for anything other than arranging recreational games, for example dating, recruiting or commercial coaching, without our written permission
- pretend to be someone else, or create fake, duplicate or automated accounts
- deliberately accept games you don't intend to play, or try to manipulate the reliability score or matching system
- scrape, copy, reverse-engineer, overload or interfere with the Service, or try to get into accounts or data that aren't yours
- break any law
Be a good sport: turn up on time, play fairly, respect everyone's skill level, and follow the rules of the venue you play at.
9. Your content
"Your content" means anything you post or upload: your first name, profile photo, chat messages, reports and feedback.
- You keep ownership of your content.
- You give us a non-exclusive, royalty-free, worldwide licence to host, store, copy, display and process your content, only as needed to run, maintain and improve the Service. For example, we show your photo and messages to the players in your games. This licence ends when your content is deleted, except where we're allowed to keep it under our Privacy Policy.
- You promise you have the right to post your content, and that it doesn't break these terms or anyone else's rights.
- Your profile photo is stored at a public web address (see the Privacy Policy). Only upload a photo of yourself that you're happy for other people to see.
We don't check content before it's posted, but we may review, hide or remove content that we reasonably believe breaks these terms. Our team reads a game's chat only when reviewing a report or complaint about that game.
10. Suspension and termination
We may warn you, deduct reliability points, suspend your account for a period of time, or close your account if we reasonably believe you've broken these terms, put other players at risk, or exposed us to legal liability. While your account is suspended, you can't start new searches, be matched into new groups or post in chats.
We'll usually tell you why we've taken action, unless doing so would put someone at risk or break the law. If you think we've made a mistake, contact us through Help & feedback.
You can stop using FillTheGame at any time. To delete your account, go to Profile and tap Delete account, or contact us through Help & feedback or at [email protected]. Deleting your account cancels any search or game you're in. So the other players aren't let down at the last minute, you can't delete your account within 24 hours of a confirmed game you're in, or while it's being played; you can delete it once the game is over. You can't delete your account yourself while it's suspended. Messages you've posted in game chats stay there, shown as "Deleted user", as our Privacy Policy explains. Sections 11 to 15 continue to apply after your account ends.
11. Your safety and physical activity
Pickleball is a physical activity with a real risk of injury. You're meeting people you may not know, in public places we don't control.
- Only play if you're fit to do so. Get medical advice if you're unsure.
- Use suitable equipment and footwear, and check the court is safe.
- Meet in public venues, tell someone where you're going, and trust your instincts. You can leave a game if you feel unsafe.
- You're responsible for your own belongings, transport and any costs, such as court hire.
You take part in games at your own risk. To the extent the law allows, we're not responsible for injury, loss or damage that happens at or on the way to or from a game, or for how other players behave. This section doesn't limit any rights you have under the law that can't be excluded (see section 12).
12. Australian Consumer Law
Nothing in these terms excludes, restricts or changes any right or remedy, or any guarantee, warranty or other term or condition, that is implied or imposed by the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other law that can't lawfully be excluded or limited ("Non-Excludable Rights").
13. Disclaimers and limits on our liability
Subject to your Non-Excludable Rights:
- The Service is provided "as is" and "as available". We don't promise that it will always be available, free of errors, or that you'll find a game.
- We're not responsible for the actions, content or conduct of other players, whether in the app or in person.
- We're not liable for any indirect or consequential loss, or for loss of profit, data, opportunity or enjoyment.
- Where our liability for failing to comply with a consumer guarantee can be limited, it's limited to supplying the Service again or paying the cost of having it supplied again.
- Otherwise, our total liability to you for all claims connected with the Service is limited to the greater of the amount you paid us in the 12 months before the claim and AUD $50.
These limits don't apply to liability that can't be limited by law, or to loss caused by our fraud, negligence or wilful misconduct.
14. Indemnity
You agree to compensate us for any loss or cost (including reasonable legal costs) that arises from a claim made by someone else because you broke these terms, broke the law, or infringed someone's rights. This doesn't apply to the extent the loss was caused by us.
15. Disputes with other players
Disputes between players, such as disagreements about a game, court costs or behaviour, are between you and the other player. We may help through our reports and complaints process, but we're not obliged to resolve them.
16. Our intellectual property
The FillTheGame name, logo, design, software and content (other than your content) belong to us or our licensors. We give you a personal, non-exclusive, non-transferable right to use the Service for your own recreational purposes, in line with these terms.
17. Changes to the Service and these terms
We're always improving FillTheGame. We may add, change or remove features, add new sports, or stop offering the Service.
We may update these terms from time to time. We'll change the effective date at the top. If a change is significant, we'll tell you by email or in the app at least 14 days before it takes effect. If you keep using the Service after a change takes effect, you accept the updated terms. If you don't agree, stop using the Service and ask us to delete your account.
18. General
- Governing law. These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that state and the Commonwealth of Australia.
- Entire agreement. These terms and our Privacy Policy are the whole agreement between you and us about the Service.
- Severability. If any part of these terms is invalid or unenforceable, it will be read down or removed, and the rest continues to apply.
- No waiver. If we don't enforce a right straight away, we haven't given it up.
- Assignment. You can't transfer your rights under these terms. We may transfer ours, for example if FillTheGame is sold or restructured.
